Wonaby terms of service

These terms are the agreement between you and us about using Wonaby. They cover the Wonaby app on iOS and Android and the wonaby.com website. By creating an account or using either, you accept them. If you do not accept them, do not use Wonaby.
Who you are agreeing with
Wonaby is operated by Alevit Digital Solutions L.P. (ALEVIT DIGITAL SOLUTIONS Ε.Ε., a Greek limited partnership), trading as Wonaby, registered in Greece (registered address: Ektos Oikismou 0, Kato Archanes, 70100 Heraklion, Crete, Greece; company number (GEMI): 174552327000; VAT number: EL802335934).

Who can use Wonaby
You must be at least 16 years old. If you are not, you may not create an account. By creating one you confirm you meet that age.
You may only use Wonaby for yourself. One account is one person.
What Wonaby is
Wonaby is a private journal. You capture moments, tag how you felt, and an AI model running on your own phone writes day notes, recaps and answers about what you wrote.
Three things about the product are load-bearing enough to say in the agreement itself:
Your journal is end-to-end encrypted. It is sealed on your device with a key derived from your passphrase, before anything reaches us. We cannot read it. That protection is real and it is also irreversible: if you lose both your passphrase and your recovery key, nobody can unlock your entries, including us. There is no reset and no back door. Keep your recovery key somewhere safe, and export a copy of your journal while you can still open the app.
The AI runs on your phone. Nothing you write is sent to us or to any AI provider to generate what you read. The model is downloaded to your device and runs there, which is also why it needs several gigabytes of storage and a device that can handle it.
What the AI writes is generated, not verified. Day notes, recaps, patterns and Ask Wonaby answers are produced by a machine and can be wrong, incomplete or misleading. They are not advice. Wonaby is not a medical device and is not a mental-health service; nothing it produces is a diagnosis, a treatment, or a substitute for a doctor, therapist or other professional. If you are struggling, talk to a professional or your local emergency service.
We may add, change or remove features. If we remove something you paid for, see Subscriptions below.
Your account
Keep your sign-in details and your device secure. You are responsible for what happens under your account. Tell us at support@wonaby.com if you think someone else has got into it.
You can delete your account at any time: tap your picture on the Home screen to open your Account, then Manage account, then Delete account. Deletion removes your account, your sealed journal and your files. It does not cancel a subscription bought through an app store; cancel that in the store, as described below.
Your content is yours
Everything you write, record and photograph in Wonaby belongs to you. We claim no ownership of it and no licence to use it. We could not use it if we wanted to: we cannot read it.
We do not moderate your journal, because we cannot see it. Wonaby has no sharing, no feed and no way to publish anything to another person, so nothing you write here reaches anyone else through us.
You are responsible for what you put in your journal being lawful for you to hold.
What you may not do
Do not use Wonaby to break the law. Do not try to get into parts of the service that are not yours, interfere with how it runs, work around the security or the encryption, or take it apart except to the extent that law you cannot contract out of allows you to. Do not scrape or automate access to the website or the app without our permission. Do not resell or redistribute the app.
Our licence to you
We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Wonaby on devices you own or control, for your own personal use, in line with these terms and with the rules of the app store you got it from. That is the whole of what you get; we keep every other right.
The Wonaby app, the website, the name, the logo and everything in them other than your own content belong to us or to our licensors.
If you got the app from the Apple App Store, this licence is between you and us only. Apple is not a party to it, has no obligation to support the app, and is not responsible for it or for any claim you have about it. Apple and its subsidiaries may enforce these terms against you as a third-party beneficiary.
Subscriptions and payment
Wonaby is free to use with limits. Wonaby Pro removes them and is sold as a monthly subscription, an annual subscription, or a one-time lifetime purchase. What each plan includes and what it costs is shown in the app before you buy, in your own currency.
Where you buy and who charges you. Purchases go through the App Store or Google Play. They take the payment, they hold your payment details, and we never see your card. Your purchase is also subject to that store's own terms.
The free trial. New subscribers are offered 14 days of Pro free. You give the store a payment method when you start it, and the store may place a temporary authorisation hold that it releases. The subscription starts charging when the trial ends unless you cancel before then. You get one trial; the store decides whether you are eligible.
Renewal. Subscriptions renew automatically at the end of each period, at the price shown, until you cancel. The store charges you within 24 hours of the period ending.
Cancelling. Cancel any time in your App Store or Google Play account settings, at least 24 hours before the period ends. Cancelling stops the next charge; you keep Pro until the period you already paid for runs out. Deleting the app does not cancel a subscription, and neither does deleting your Wonaby account.
Refunds. Refunds are handled by the store you bought from, under that store's policy, not by us. We cannot issue a refund for a store purchase. Write to us anyway if something went wrong and we will help you take it to the right place. This does not affect the statutory rights below.
Price changes. If we change the price of a plan you are on, you will be told in advance through the store, and the change only applies from your next renewal. You can cancel before it takes effect.
Lifetime. A lifetime purchase covers Pro features for as long as we operate Wonaby. It is not a promise that we will operate it forever. If we discontinue Wonaby, see Ending this agreement.
If you are a consumer in the EU or EEA
Nothing here takes away rights the law gives you and you cannot sign away.
Your 14-day right to change your mind. You normally have 14 days to withdraw from a distance contract for digital content or a digital service, without giving a reason. When you buy Pro, you get access immediately, which means you are asking us to start supplying before those 14 days are up. By buying, you expressly ask for that and acknowledge that you lose the right of withdrawal once supply has begun. If you would rather keep the right, do not buy; the free tier stays open.
Where the right does still apply, exercise it through the store you bought from within 14 days of the purchase.
Digital content quality. You are entitled to digital content and services that match their description and work as they should. If Wonaby does not, you can ask us to fix it and, if we cannot, to reduce the price or end the contract. Contact us at support@wonaby.com.
Disputes. You can use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged to use an alternative dispute resolution body and do not currently commit to one.
What we promise, and what we do not
We provide Wonaby with reasonable skill and care. Beyond that, and beyond what the law requires us to promise, Wonaby is provided as is and as available. We do not promise it will be uninterrupted, error-free, or that the AI will be accurate or useful for you.
You are responsible for keeping your own copy of anything you would be upset to lose. Wonaby's export exists for exactly that. Because your journal is sealed with a key we do not hold, we cannot recover it for you under any circumstances.
Liability
We are liable to you for foreseeable loss caused by our breaking these terms or failing to use reasonable skill and care.
We are not liable for indirect or consequential loss, for loss of data you could have kept a copy of, or for loss caused by something outside our reasonable control.
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us limit. If you are a consumer, nothing here affects your statutory rights.
Where liability can be limited, our total liability to you for everything connected to Wonaby in any 12-month period is limited to the greater of what you paid us in that period and fifty euros.
Ending this agreement
You can stop at any time by deleting your account.
We can suspend or close your account if you seriously or repeatedly break these terms, if we have to for legal reasons, or if keeping it open would put the service or other people at risk. Unless the law stops us, we will tell you why and, where the problem can be fixed, give you a chance to fix it first. If we close your account without you having broken these terms, we will refund the unused part of anything you have paid.
If we discontinue Wonaby we will give you reasonable notice, at least 30 days, so you can export your journal, and we will refund the unused part of any subscription. A lifetime purchase in that situation is refunded pro rata over 24 months from the date of purchase.
Changes to these terms
We may change these terms. If a change matters to you, we will tell you in the app or by email before it takes effect and say when it does. Carrying on using Wonaby after that means you accept the new terms; if you do not, stop using Wonaby and delete your account.
Privacy
How we handle your personal data is in our privacy policy at wonaby.com/privacy. It is part of the deal, so read it.
The rest
If a court finds part of these terms unenforceable, the rest stays in force.
Not enforcing something once does not mean we give up the right to enforce it later.
These terms are the whole agreement between us about Wonaby.
You may not transfer your rights under these terms to anyone else. We may transfer ours if we sell or reorganise the business, and we will tell you if we do; it will not reduce your rights.
Law and courts
These terms are governed by the law of the Hellenic Republic (Greece) and applicable EU law. Disputes go to the courts of Athens, Greece.
If you are a consumer living in the EU or EEA, you keep the protection of the mandatory law of your own country, and you can also bring proceedings in your own country's courts.
